FAQ : How long has the provisional patent existed in France?

The provisional patent was already well known in the United States as a means of filing a rapid patent, making it possible to date and protect one’s invention quickly. Guy Kawasaki, one of Apple’s first marketing managers, speaks of the provisional patent as a technique for protecting and promoting one’s know-how. In this sense, the patent represents not only an administrative procedure to protect against counterfeiting, but also a communication tool to assert oneself as a relevant player in one’s market. Previously, the provisional patent was not one of the tools available in France for protecting its industrial property. It was instituted under the PACTE law and decree no. 2020-15 of January 8, 2020. It has been possible to file a provisional patent since July 1, 2020.
