An industrial property audit is an in-depth assessment of a company’s Intellectual Property (IP) strategy. It aims to identify the strengths and weaknesses of this strategy and provide recommendations for optimizing it.
An industrial property audit can cover various areas, such as :
– patents,
– brands,
– designs and models,
– business secrets,
– contracts,
– employee and non-employee invention policy, etc…
How does an IP audit work?
An industrial property audit can be carried out in a variety of ways, but generally includes :
- an analysis of the industrial property strategy in place,
- an assessment of the strategy’s compliance with current regulations,
- identify potential optimization opportunities, particularly for large portfolios or older portfolios, and
- a presentation of recommendations for improving the company’s industrial property strategy.
The reasons for an audit
There are several reasons why it may be useful to audit your industrial property strategy.
- Evaluate the relevance of the industrial property strategy in place: the audit can verify that the strategy in place is adapted to the company’s objectives and the needs of its customers.
- Identify any weaknesses in the strategy: the audit can identify any gaps or shortcomings in the industrial property strategy in place, and suggest areas for improvement.
- Evaluate the strategy’s compliance with current regulations: the audit can ensure that the industrial property strategy complies with the regulations and standards in force in your field.
- Detecting opportunities to optimize strategy: the audit can highlight opportunities to optimize industrial property strategy, for example by identifying areas where the company’s industrial property protection could be strengthened. But also to abandon certain property titles which would no longer protect marketed innovations. Or abandoning industrial property titles whose innovation is obsolete or no longer valued.
- Improve internal and external communication on industrial property strategy: the audit can help clarify and formalize the company’s industrial property strategy, which can be useful for communicating with the company’s various stakeholders (employees, partners, investors, etc.) on this topic.
The results of the industrial property audit can be used by the company to improve its industrial property strategy, to better target its investments in intellectual property protection and to strengthen its market position.
