The E-Soleau envelope enables you to prove the date of creation of an invention, and to keep this proof permanently. So if a competitor files a patent on your invention and sues you for infringement, you can prove that you had prior personal possession and can continue to exploit your product.
Contents of an E-Soleau envelope
All types of documents can be included in an electronic Soleau envelope, such as: Texts, Images, Photographs, Sketches, Videos, Musical creations, Computer codes, Manuscripts.
INPI certifies that you possessed these documents on the date of filing, thus providing time-stamped proof. This procedure is particularly advantageous for companies, enabling them to build up evidence quickly and cost-effectively in the event of a dispute.
The Soleau envelope does not protect an invention from copying. For that, a patent is required.
Limitations of the E-Soleau Envelope (new procedure since April 2024) :
Period of validity : 5 years, renewable every 5 years up to 20 years. If you forget to renew, you lose the proof. Must pay for each renewal
Number and weight of documents : 1 to 100 files, up to a total of 2GB. For heavier source code, you’ll need to register with the Agence de Protection des Programmes (APP).
